Terms and Conditions

Phil is operated by Philosonic, a company incorporated and registered in South Africa at Rosebank, Gauteng. In these terms “we”, “us” and “Phil” mean that company. For anything about these terms, contact adam.ismal1@icloud.com.

Phil is a platform that reads information you upload or connect, such as spreadsheets, PDFs, images, and other documents, and answers questions about it, surfaces things worth noticing on its own, and generates reports. Phil only reads: it never writes back to Google Sheets or any other system you connect, and it never takes an action on your behalf inside another tool.

Phil is informational. Any answer, insight, or report Phil produces is generated from the data you gave it and should be checked by you before you rely on it for a real decision. Phil is not a substitute for professional financial, legal, accounting, or business advice, and nothing it produces should be treated as such.

You need an account to use Phil, created either with an email address and password or by signing in with Google. You must be at least 18 to create an account. You are responsible for keeping your login credentials secure and for everything that happens under your account, so tell us straight away at adam.ismal1@icloud.com if you think someone else has access to it.

You agree to give accurate information when creating your account and to keep it up to date. We may suspend or terminate an account created with false information.

Whatever you upload to Phil, whether a file, a connected spreadsheet, or a message in chat, remains yours. We do not claim ownership over it. By uploading or connecting it, you grant us a licence to store, process, and analyse it, and to send it to the third parties described in our Privacy Policy, solely for the purpose of providing Phil to you. That licence ends when the data is deleted, whether automatically under your retention setting or because you deleted it or your account yourself.

You are responsible for what you upload. You confirm that you have the right to upload and process any data you give Phil, including personal information about your own customers, staff, or anyone else it might contain, and that doing so doesn't break any law or any agreement you have with someone else. Do not upload anything you don't have the right to share, and do not upload illegal content.

Phil lets you choose a “Philosophy”, a voice modeled on a real or historical figure, to change how Phil frames its answers. A Philosophy changes tone and framing only, never the underlying facts, which always come from your own data.

Every Philosophy modeled on a real person, meaning all of them except Phil itself, is a persona inspired by that person's publicly known writing, interviews, or, for historical figures, the historical record. None are affiliated with, endorsed by, or connected to the named individual, their estate, or their companies, none speak on their behalf, and none should be understood as making any statement by that actual person. You agree not to represent output from a Philosophy as an actual statement, endorsement, or opinion of the real person it is modeled on.

You agree not to use Phil to break the law, to upload malware or attempt to compromise Phil's security, to attempt to access another workspace's data, to reverse engineer or scrape Phil, to resell or provide Phil as your own service to third parties without our agreement, or to use Phil in a way that places excessive load on the infrastructure it runs on. We may suspend or terminate access for anyone who does.

If you connect a third party service such as Google Sheets, you are responsible for making sure you have the right to connect it and that doing so doesn't breach your agreement with that provider. Phil requests only read access to any service you connect, described in full in our Privacy Policy, and we are not responsible for the availability or behaviour of third party services themselves.

Your data is kept for the retention period you set in your workspace, between 7 and 90 days, and deleted automatically once that period passes. You can delete any individual file, or your entire account, at any time from inside Phil. Full detail is in our Privacy Policy.

Phil does not currently charge for use. The plans shown on our Pricing page are illustrative only, and final pricing has not been set. If and when we introduce paid plans, we will tell you before any charge applies to your account, and separate terms covering billing, refunds, and cancellation will apply from that point on.

You can stop using Phil and delete your account at any time. We may suspend or terminate your account if you break these terms, if we reasonably believe your use of Phil creates legal or security risk, or if we stop operating Phil altogether, in which case we will give you reasonable notice where we can so you have a chance to get your data out first.

Phil is provided as is. We do our best to keep it accurate, available, and useful, but we do not guarantee that it will be uninterrupted, error free, or that any answer, insight, or report it produces will be accurate or complete. You are responsible for checking anything important against your actual data before relying on it.

To the fullest extent the law allows, Philosonic is not liable for any indirect, incidental, or consequential loss arising from your use of Phil, including lost profits or lost data, and our total liability for any claim relating to Phil is limited to the greater of R5,000 or the fees you paid us in the past 12 months. Nothing in these terms limits liability where the law does not allow it to be limited, such as for fraud or death or personal injury caused by negligence.

You agree to cover any loss, claim, or expense Philosonic faces arising from data you upload that you did not have the right to share, or from your use of Phil in a way that breaks these terms or the law.

These terms are governed by the law of South Africa, and the courts of South Africa have exclusive jurisdiction over any dispute arising from them.

If we change these terms, we will update this page and change the date at the top. If the change is significant, we will tell you rather than hope you notice, the same approach we take with our Privacy Policy.
